At Mithra (“we,” “our,” or “us”), your privacy is important to us. This document outlines how we collect, use, store, share, and protect your personal information when you access or use the Mithra mobile application, website, or any related services (collectively, the “Services”). By using our Services, you acknowledge and agree to the practices described in this document.
Eligibility to Use Our Services
Our platform helps you connect with new people based on your preferred language, enabling you to discover friendships and create meaningful connections. You are free to interact with as many individuals as you wish and enjoy personalized experiences through our services (“Service” or “Services”).
You may use our Services only if you are legally eligible to form a binding agreement with us and are not prohibited from doing so under applicable law. If you are using the Services on behalf of a company or another legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, references to “you” and “your” will refer to that entity.
Please make sure that using our Services is lawful in your jurisdiction before proceeding.
How To Use Our Services
Mithra offers a unique platform designed to provide content and connections in regional languages. Our goal is to deliver a personalized experience by showing you content that aligns with your preferences and interests.
To access our Services, you must register on the Platform using your mobile phone number. We will send a One-Time Password (OTP) via SMS, which you must enter to complete the registration process. Please note that we do not access or read any information stored on your mobile device or computer without your explicit permission.
To enable certain features and ensure a seamless experience, we may require access to specific functionalities on your mobile device, such as network connectivity or notifications. Any such access will be requested and used solely to improve your experience with our Services.
Your Commitments
At Mithra, we strive to provide a safe, inclusive, and engaging platform for a diverse community. In return for our commitment to delivering a secure and enjoyable experience, we ask you to agree to the following commitments. You are solely responsible for your actions on the Mithra platform, including any violations of these Terms.
By using our Services, you agree to the following:
1. No Impersonation or False Information
You are not required to use your real name; however, you must provide accurate information such as your correct phone number and gender when registering. You must not impersonate another person or misrepresent your identity. If you operate a parody account for satire or comedic purposes, it must be clearly stated in your Mithra profile bio.
2. Device Security
We take steps to protect the Platform, but no system is completely immune to risks. You are responsible for safeguarding your device by installing up-to-date antivirus and anti-malware software. Do not share your phone number with others for account access or link multiple accounts to the same number. You are liable for all activity from accounts associated with your number.
While we strive to secure the Platform, you must also ensure that your devices are not misused or compromised.
3. Content Removal and Account Termination
Your use of Mithra must comply with our Content and Community Guidelines. If your content is reported for violating these guidelines, we may remove it. Repeated or severe violations can result in suspension or termination of your account. You may appeal any content removal by contacting us at [developer@mithra-live.com].
We reserve the right to remove any content that violates our guidelines or applicable laws.
4. Lawful and Respectful Use
Mithra is a space that embraces cultural and linguistic diversity. However, you must not use the Platform to share content that is illegal, obscene, pornographic, harmful to minors, discriminatory, promotes hate speech, incites violence, or violates any law in India.
We reserve the right to remove such content and may report it to law enforcement authorities if necessary. This includes sharing user data in good faith when required by law or to protect the safety of individuals, our Platform, or the public.
Please use Mithra responsibly and refrain from posting content that could harm others or undermine societal well-being.
5. Content Ownership and Responsibility
You retain full ownership of the content you post on Mithra, including photos, videos, music, and updates. However, by posting content, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, host, reproduce, display, distribute, and create derivative works, in accordance with your privacy settings.
You may delete your content or account at any time. However, content shared with others may remain visible, and we may retain certain data for a limited time in accordance with our data retention policies.
You are solely responsible for your actions and content. Mithra does not endorse or take responsibility for content posted by users, even if it features our branding. We are not liable for any consequences of interactions or transactions between users or with advertisers on the Platform.
6. Intermediary Status and Limited Liability
Mithra operates as an intermediary under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. These Terms are published in compliance with Rule 3(1) of the aforementioned Rules.
Our role is limited to providing a platform for users to share and access content. We do not control or endorse user content and are not responsible for any consequences arising from content shared or actions taken by users.
Our liability is limited by Indian law. We are not responsible for indirect, incidental, punitive, or consequential damages, including data loss or profit loss, even if foreseeable.
7. No Disruption or Malicious Activity
You must not interfere with the functioning of the Platform or attempt to gain unauthorized access to any part of the system. This includes introducing malware, using bots, scraping data, or probing security vulnerabilities.
Any such attempts will result in immediate termination of your account and may be reported to legal authorities for further action.
We are committed to maintaining a safe environment, and any action that threatens our technical integrity or user security will be dealt with strictly.
COMPLIANCE REQUIREMENTS
In accordance with applicable regulations, publishers of news and current affairs content are required to share details of their Mithra user accounts with the Ministry of Information and Broadcasting, Government of India.
PERMISSIONS YOU GRANT US
By using our Services, you acknowledge and accept these Terms and grant us certain permissions that help us enhance your experience on the Platform. These include:
1. Permission to Share Your Profile Information with Third Parties
To keep our Services free and accessible, Mithra may generate revenue through sponsored content and advertisements. For this purpose, we may share data such as your username, profile picture, gender, and your interaction or usage patterns on the Platform with third parties.
We do not pay revenue shares for purchases made through advertisements displayed on the Platform, nor do we endorse or verify the authenticity of any advertised products. An advertisement on Mithra does not constitute an endorsement by us.
In cases where sharing of sensitive personal information (as defined under applicable law) is required, we will obtain your explicit consent prior to doing so.
2. Automatic Downloads and Updates
To ensure continued functionality and improved features, Mithra regularly updates its mobile application. You may be required to download the Mithra app and install periodic updates to continue using the Services without interruption.
Using the most recent version of the application may be necessary to access certain features and to maintain the security and performance of the Platform.
3. Permission to Use Cookies and Similar Technologies
We may use technologies such as cookies, web beacons, pixel tags, mobile identifiers, flash cookies, and similar tools to collect and store information related to your use of our Services or third-party websites.
Cookies help improve your experience by storing user preferences and activity logs. By using Mithra, you consent to our use of these technologies in accordance with our Privacy Policy.
4. Data Retention
We may retain certain information related to your use of the Platform as required for operational, legal, and analytical purposes. This includes data you provide and data generated through your use of the Services.
By using Mithra, you grant us the right to collect, process, store, and retain your personal data in line with our data handling practices. For more details, please refer to the Mithra Privacy Policy.
DISPUTE RESOLUTION
1. Assignment of Rights
These Terms apply solely to you and may not be transferred, assigned, or delegated to any third party without our prior written consent. However, Mithra reserves the right to assign or transfer its rights and obligations under these Terms, including in connection with a merger, acquisition, or corporate restructuring.
2. Governing Law and Jurisdiction
All disputes arising from or relating to these Terms, your use of the Platform, or our Services shall be governed by the laws of India. You agree to submit to the exclusive jurisdiction of the courts located in Bangalore, Karnataka.
GRIEVANCE REDRESSAL MECHANISM
We are committed to ensuring user safety, privacy, and compliance with applicable regulations. Mithra has appointed a Grievance Officer to address and resolve user concerns regarding content, privacy, and other platform-related issues.
You may raise a grievance through the following mechanisms:
Report inappropriate content or user profiles directly from the app via the feed, during a call, or after a call from the call history. Select the appropriate reason and click the Report option.
Track your complaint status through the Reports page in the Profile Settings.
Appeal content removal or violations via the Violations page in Profile Settings. You can add comments and supporting information as part of your appeal.
Email us directly at developer@mithra-live.com to raise concerns. You will receive a ticket number for tracking purposes. We will address your issue in accordance with our policies and legal requirements.
LIMITATION OF LIABILITY
Mithra provides the Platform and Services on an “as is” and “as available” basis. We do not make any representations or warranties regarding the reliability, quality, or availability of the Services, including uninterrupted or error-free access.
We shall not be held liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of your use of or inability to use the Platform or Services, including but not limited to loss of data, profits, or goodwill, even if we have been advised of the possibility of such damages.
In the event that any limitation or exclusion of liability is deemed unenforceable by law, our liability shall in no case exceed the total amount you have paid, if any, to use the Platform or Services in the month prior to the date of the claim.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Mithra, its affiliates, officers, directors, employees, agents, successors, and assigns from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorney’s fees) arising from or related to:
Your use of or access to the Platform or Services;
Any breach of these Terms by you;
Your violation of any third-party rights, including intellectual property or privacy rights;
Your breach of any applicable law or regulation;
Any negligence, fraud, or misconduct on your part.
This indemnification obligation shall survive the termination of these Terms.
UNSOLICITED MATERIAL
We appreciate user feedback and suggestions. However, any ideas, suggestions, or other unsolicited materials submitted to us may be used by Mithra without any obligation to compensate you or maintain confidentiality.
GENERAL TERMS
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply in full force.
Any amendment or waiver of these Terms must be in writing and signed by Mithra to be valid.
Our failure to enforce any part of these Terms does not constitute a waiver of our rights.
We reserve all rights not explicitly granted to you under these Terms.
